Subramanian Swamy accuses Gandhis of Rs 1,600 crore fraud, Rahul threatens to sue him

NEW DELHI, Nov 01 (CMC) Following Janata Party president Subramanian Swamy's news conference on Thursday where he accused Congress general secretary Rahul and his mother and party president Sonia Gandhi of grabbing Rs 1,600 crore worth of public property and insinuation of perjury, Rahul Gandhi's office has threatened Swamy of legal action through a communication to him.
Rahul Gandhi's office in the communication to Swamy said, "Our attention has been drawn to your purported press conference of the afternoon of November 1. The allegations made by you are utterly false, entirely baseless and defamatory ... Your action of calling a press conference is a motivated attempt for reasons, which one can easily discern."
The communication further said, "We are committed to pursuing all legal actions against the scandalous abuse evident in your so-called press conference. Please be informed that we shall pursue the legal remedies open to us against the utterly motivated and irresponsible contents of your press conference ... And, that we shall pursue all proceedings that are available in law to ensure that an individual like you do not abuse the freedom to speak and write in utter violation of the equal important need in a civilized society to maintain the dignity of individuals and organizations and to abide by the law of the country."
Also, Congress general secretary Digvijaya Singh said that Swamy's charges are baseless and he should not be taken seriously.
Earlier in the day, the Janata Party president held a news conference and accused scion of Nehru-Gandhi family and ruling Congress party leader Rahul Gandhi of running a fraud company and of misusing government facilities.
Swamy alleged that Rahul and Sonia jointly owned 76 per cent of a company called Young Indian.
He said that public funds were converted to finance the privately-owned company. He has also claimed that meetings of the company were held at 10 Janpath, Sonia Gandhi's govt-allotted official residence, which was against the law.
He said that Young Indian now 'owns' the Herald House in Delhi and two floors of it have been rented out to passport office that pays the company Rs 30 lakhs a month as rent, of which, 76 per cent goes to Rahul and Sonia.
"Mrs Sonia Gandhi and Rahul Gandhi had floated a Section 25 private company called Young Indian, and acquired the public limited company, Associated Journals Ltd, which is the owner of National Herald and Quami Awaz Newspapers, and all high value real estate property in Delhi and other places in Uttar Pradesh of the said company. The deal is a sham, bogus, and a violation of several laws. It is a fraud committed in order to grab the Herald House in Delhi, that is located in a hub and which is valued at about Rs 1,600 crores," Swamy said.
"The first dubious fact of the AJ Company RoC (registrar of companies) details is that Jawahar Lal Nehru, Indira, Feroze Gandhi, GD Birla and other like noted deceased person, are shown as current shareholders. In fact 80 per cent of the original shareholders are no more alive. So, too many of the defunct firms, including several companies having dubious addresses in Kolkata, are shown as shareholders of Associated Journals Ltd," he added.
Swamy also accused Rahul of not disclosing about this company in his affidavit to the Election Commission while filing his nomination for the 2008 Lok Sabha elections.
He said, "In his election affidavit on assets and liabilities, Mr Rahul Gandhi had failed to inform that he owned 38 per cent share of a company he had formed named Young Indian with his mother, Ms Sonia Gandhi, who also owned 38 per cent of the shares."
On misusing government-allotted premises to hold commercial activity, Swamy said, "... dubious fact is that Young Indian filed statements with the RoC disclosing that the shareholders meeting was held in Sonia Gandhi's government allotted 10 Janpath. This is violation of the law since the 10 Janpath, New Delhi government accommodation cannot be used for commercial purposes and business," he added.
Swamy has demanded an inqury into the case.
He said, "... I urge immediate institution of a SFIO/CBI probe into this dubious stinking deal between Young Indian and Associated Journals as also the illegality of the AICC in giving a loan to a private company in reckless cronyism since the AICC president is Mrs Sonia Gandhi and general secretary Rahul Gandhi who are also owners of Young Indian, the beneficiary."
"More curiously, Associated Journals Ltd's chairman Shri Motilal Vora is also the treasurer of the AICC," he added.
It may be recalled that Subramanian Swamy had accused Sonia Gandhi of various frauds and illegal activities and dared her to take him to court. The Congress president has so far ignored his charges and remarks.
