Bangalore, Nov 3(CMC) Arrested nearly three weeks back, former Chief Minister B S Yeddyurappa will have to wait for at least one more day to know whether he can walk out of jail with the Karnataka High Court today granting bail in a graft case while reserving till tomorrow its order in another.
Justice B V Pinto allowed the bail plea by 68-year-old Yeddyurappa in one of the two complaints in which he has been arrested and reserved order on the other after arguments by both parties. He cannot leave prison till he gets bail in both cases.
Even as Yeddyurappa got relief on a complaint in which he has been accused of denotifying government land for personal gains, the order tomorrow on another complaint will decide whether he will walk free from judicial custody.
He was arrested on October 15 for his alleged involvement in the scam that saw his family members getting prize land at throwaway prices while he was chief minister.
Justice Pinto said criminal jurisprudence principles would not go to the extent of denying a person the right to personal liberty on the basis of allegations levelled against him, while ordering conditional bail to Yeddyurappa who has been directed to furnish a surety for Rs five lakh and not to destroy evidence.
The judge said it was too early to decide if Yeddyurappa was guilty or not as the credence of documents submitted to the court was yet to be proved..
Yeddyurappa was directed by BJP to step down after a report on illegal mining indicted him.
Soon after his arrest, Yeddyurappa complained of ill health and was moved to two hospitals. Doctors who attended to him said he was fit to return to jail, leading to allegations that the politician was trying to avoid prison by complaining of chest pains, a charge denied by him.
The order on bail plea of former minister S N Krishnaiah Shetty, arrested along with Yeddyurappa, has also been reserved for tomorrow by the court.
The court issued notice to the Superintendent of the Bangalore central prison seeking explanation for the reasons for not producing Yeddyrappa before it while declining to accept the plea that it was due to lack of police personnel.
Meanwhile, Justice H Billappa adjourned further hearing to November 8 on anticipatory bail applications moved by Yeddyurappa and his family members, apprehending arrest in three other complaints filed by Advocate Sirajin Basha, proceedings of which are on before the Lokayukta Court.
Besides Yeddyurappa, his two sons, B Y Raghavendra, a Lok Sabha member and B Y Vijendra and son-in-law R N Sohan Kumar who are among the other accused, have sought anticipatory bail.
Lokayukta Court judge N K Sudhindra Rao extended the judicial custody of Yeddyurappa and Setty till November 15.
