2G scam: Kanimozhi, 7 others denied bail

New Delhi, Nov 03 (CMC): A special CBI court on Thursday denied bail to DMK MP Kanimozhi and seven others accused in the 2G spectrum allocation scam.

CBI Judge O P Saini dismissed the bail pleas of the accused and posted the case for further hearing on November 11, when the trial will begin.

In its judgement, the court said that the bail is being denied not due to external influence but on the basis of circumstantial evidence as the charges levelled against the accused are very serious in nature, having grave implications for the economy.

The court further said that it is a deliberate economic offence and involves public money.

On Kanimozhi, the court said, “By no stretch of imagination Kanimozhi can be said to be suffering from any discrimination on ground of being a woman.”

The accused may move the High Court for bail, however as the case is under the scrutiny of the Supreme Court, the apex court’s view on it would be important.

Importantly, the CBI had during the last hearing had told the court that it does not oppose bail to Kanimozhi and four others -- Bollywood producer Karim Morani, Directors of Kusegaon Fruits & Vegetables Asif Balwa, Rajiv Agarwal and Kalaignar TV MD Sharad Kumar.

However, the bail plea of two other accused Shahid Balwa and RK Chandolia was opposed by the CBI.

Giving reasons for not opposing the bail, Special public prosecutor UU Lalit said Kanimozhi and four others faced "specific" charges, apart from the "umbrella section" of 120-B (criminal conspiracy) IPC, which entail only five years sentence as maximum punishment.

"Let’s put Shahid Balwa and Chandolia in different category at this stage...I submit, one can make distinction so far as those for whom maximum punishment can be five years and those against whom maximum punishment can be seven years.
